Rear Seat Headrests

I have a 2017 RDX and the issue I have seems to effect all 17 RDX's. My rear headrests are always positioned in the down position. This problem seems to be with the passenger side rear headrest only. When I put the seat down to load something the headrest moves up. After putting the seat up again I have to re-position the headrest in the down position. On it's first service I asked them to check to see if there is something wrong with the headrest lock in the down position, they said this issue is normal for all the RDX's and there is nothing wrong. Well, why would they put a locking slot for the down position if that is true?
This is a pain as the headrest in the first up position gets in the way of my clear view thru the rear window. Anyone think this is odd or am I just being nit picky?
