Well, I'm pretty sure that you can go after him directly and hopefully settle it privately. If he doesn't cooperate then sue him.

I would use your own insurance company only as a last resort. In California, if the accident is not your fault and you open up a claim with your own insurance, it is against the insurance code to raise your premiums because of that. Well, as long as your own insurance has determind that you are 50% or less at fault, they cannot raise your rates. For insurance companies, it really doesn't matter what the police report says since the investigating officer was not there when the accident occurred. A good insurance adjuster would always obtain statements from everyone involved, including any witnesses and make their decision based on it, not from what the police report says.rominl said:

On valentines day, my car got hit in the back by a 1981 ford thunderbird in a club parking lot... it wasn't my fault and today, i went get the police report, then i called the other side. What, i found out was that the dude cancelled his insurance in january now i can't file a claim with that dude. now i dont know what to do...help me out guyssss!!
