Car Accident, need help

Car accident...need help!!
hey guys,
On valentines day, my car got hit in the back by a 1981 ford thunderbird in a club parking lot... it wasn't my fault and today, i went get the police report, then i called the other side. What, i found out was that the dude cancelled his insurance in january now i can't file a claim with that dude. now i dont know what to do...help me out guyssss!!

Well, I'm pretty sure that you can go after him directly and hopefully settle it privately. If he doesn't cooperate then sue him.
How bad is the damage?
well....my bumper is messed up....and maybe the metal inside of it, and mayb the exhaust. i didn't check yet...i would say about 1g of damage
I would get an estimate then send it to him...if he doesn't pay take him to Court. I'm sure he doesn't want to deal with this in the Court system. He doesn't have car insurance, they'll probably take his license away and/or fine him plus make him pay for your damages.
yes in that case contact the guy or sue him for the money and repair
How about contacting your own insurance and let them pay for your damage, then let your insurance pursue him instead of you. There is a reason why you pay for insurance, so they can do all these things for you.

I would use your own insurance company only as a last resort. I always find that they use any excuse to hike up the premium, even if an accident is the other guy's fault. :mad:
Man this sucks.:( Get an estimate and make him pay. If he don't take him to court and a judge will more than likely order him to pay for the damages.

I work for an insurance company. In California, if the accident is not your fault and you open up a claim with your own insurance, it is against the insurance code to raise your premiums because of that. I've used my insurance many times when it was not my fault, premium never went up, in fast, it goes down evey time we re-new our policy.

really?????!!!!!!! there is such a code? damn that's some very good news for my reference

but, what's a good "proof" that something isn't your fault? police report?

Well, as long as your own insurance has determind that you are 50% or less at fault, they cannot raise your rates. For insurance companies, it really doesn't matter what the police report says since the investigating officer was not there when the accident occurred. A good insurance adjuster would always obtain statements from everyone involved, including any witnesses and make their decision based on it, not from what the police report says.

so that means after all it depends on the adjuster to determine who's at fault and the % right? that's some good info.
Yeah, I was involved in an accident where my own insurance company found that I was at fault even though the circumstances were such that it should have been the other guy's fault. I had to file a claim with the state Department of Insurance before my insurance company gave in and changed their decision.
Check to see if you have UM coverage.


BTW, insurance premium determines the insured's driving record whenever you re-new the policy. So, if you have a proof that it was not your fault, the insurance rate will not go up even though you use your insurance company to fix the car.

That's what I am doing now. :(

Go check your insurance policy. If you have Uninsured Motorist-PD, most likely your deductible will be waived.

I'm sorry to hear about the accident, you must goto your insurance company and inform them about the accident. this is best solution
